黑龙江省方正县人民政府关于建立完善守信联合激励和失信联合惩戒制度加快推进信用方正建设的实施意见

  为贯彻落实(shi)《国务院关于深入推进(jin)实(shi)施新一轮东(dong)(dong)北振(zhen)兴战略加快推动东(dong)(dong)北地(di)区经济(ji)企稳向好若(ruo)干重要举措的意见》(国发〔2016〕62号)、《国务院关于建立完善守信联合激励和失信联合惩戒制度加快推进社会诚信建设的指导意见》(国发〔2016〕33号)、《黑龙江省人民政府关于建立完善守信联合激励和失信联合惩戒制度加快推进社会诚信建设的实施意见》(黑政规〔2017〕5号)和《哈尔滨市人民政府关于建立完善守信联合激励和失信联合惩戒制度推动信用东北建设实施意见》(哈政规〔2017〕24号)精神,积极构建以信用为核心的行政管理、市场监管和社会治理体系,加快推进“信用方正”建设,现结合我县实际,提出如下意见。

  一、总体(ti)要求

(一(yi))指(zhi)导思想

  全面贯(guan)彻党(dang)的(de)十九大和习近平总书记系列重(zhong)要讲(jiang)话精神,按照国家省和市的(de)决策部署,紧紧围绕“四个全面”战略布局和“五大”发展理念,落实加强和创新社会治理要求,加快推进全县社会信用体系建设。加强信用信息归集共享、公开应用,依法依规运用信用激励和约束手段,构建政府、社会共同参与的跨地区、跨部门、跨领域的守信联合激励和失信联合惩戒机制,促进市场主体依法诚信经营,维护市场正常秩序,营造良好信用环境。

(二)基本(ben)原则

1.坚持信(xin)(xin)用(yong)公开(kai)(kai)。在做(zuo)好信(xin)(xin)用(yong)信(xin)(xin)息记录归集工作(zuo)的基础上(shang),逐步将社会(hui)法人、自然人和社会(hui)组织等各类社会(hui)信(xin)(xin)用(yong)主体的信(xin)(xin)用(yong)信(xin)(xin)息统一归集并公开(kai)(kai)。

2.坚(jian)持奖惩分明。充分运用信用激励和约(yue)束手段,建(jian)立健全守信者受益、失信者受限的奖惩机制。

3.坚持突出重点。着力解决涉及公共(gong)利益和安全、人(ren)民(min)群(qun)众反映(ying)强烈、对社会(hui)发展(zhan)负(fu)面(mian)影响较大的重点领域失信(xin)问题。

4.坚持协同联动(dong)。构(gou)建政府部门(men)协同联动(dong)、行业组织自律管(guan)理、信用(yong)服(fu)务机构(gou)积极(ji)参与、社会舆论(lun)广(guang)泛监督的共同治(zhi)理格局。

(三)工作目标

  进一步(bu)加大失信违约惩戒力度,突(tu)出抓好政(zheng)(zheng)府违约专项整治,大力倡导做诚信之人、办诚信之企、建诚信政(zheng)(zheng)府。到2018年4月底,基本建立经济社会主要领域守信联合激励和失信联合惩戒机制。到2020年,初步形成政府部门协同联动、行业组织自律管理、信用服务机构积极参与、社会舆论广泛参与的共同治理工作格局,基本建立跨地区、跨部门、跨领域的守信联合激励和失信联合惩戒工作机制,以信用为核心的新型市场监管机制作用得到有效发挥,全社会信用意识普遍增强,“信用方正”建设取得积极效果。

  二(er)、重点工作任务(wu)

(一(yi))建立完善守信(xin)联合激(ji)励机制

1.多渠(qu)道(dao)(dao)选树诚(cheng)信(xin)(xin)(xin)(xin)典(dian)型。2018年(nian)4月底(di)前,各部门和社(she)会(hui)(hui)(hui)组(zu)织建(jian)立(li)并完善(shan)社(she)会(hui)(hui)(hui)法(fa)人(ren)(ren)、自然人(ren)(ren)和社(she)会(hui)(hui)(hui)组(zu)织信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)评(ping)价机制(zhi),及(ji)时、全面、准确记录信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)主(zhu)体的信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)信(xin)(xin)(xin)(xin)息(xi)(xi);建(jian)立(li)常态(tai)化报送(song)工作机制(zhi),依托市信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)信(xin)(xin)(xin)(xin)息(xi)(xi)共享平台共享信(xin)(xin)(xin)(xin)息(xi)(xi),联合相关(guan)部门和社(she)会(hui)(hui)(hui)组(zu)织实(shi)施守信(xin)(xin)(xin)(xin)激励。开展诚(cheng)信(xin)(xin)(xin)(xin)创建(jian)活动,依法(fa)依规将信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)状况良好(hao)的行(xing)(xing)政相对人(ren)(ren)、“诚(cheng)信(xin)(xin)(xin)(xin)示范单位”、“守合同(tong)重信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)”企业、“诚(cheng)信(xin)(xin)(xin)(xin)经(jing)营示范点”、诚(cheng)信(xin)(xin)(xin)(xin)道(dao)(dao)德模范、优秀青年(nian)志愿者、行(xing)(xing)业协会(hui)(hui)(hui)商会(hui)(hui)(hui)推荐的诚(cheng)信(xin)(xin)(xin)(xin)会(hui)(hui)(hui)员、新闻媒体挖掘的诚(cheng)信(xin)(xin)(xin)(xin)主(zhu)体等(deng)树立(li)为(wei)诚(cheng)实(shi)守信(xin)(xin)(xin)(xin)典(dian)型。(县市场监(jian)管局(ju)(ju)、县文明办、县民(min)政局(ju)(ju)分(fen)(fen)别牵头,各部门按职责分(fen)(fen)工负责)

2.完善行(xing)(xing)政(zheng)(zheng)(zheng)审(shen)批(pi)(pi)绿色(se)通(tong)道。2018年3月底前,各(ge)部门行(xing)(xing)政(zheng)(zheng)(zheng)审(shen)批(pi)(pi)机构(gou)依(yi)据权力(li)清单(dan)和责(ze)任清单(dan),针对(dui)诚信典型和连(lian)续(xu)3年无(wu)不(bu)良信用记录(lu)的(de)(de)行(xing)(xing)政(zheng)(zheng)(zheng)相对(dui)人,制定实(shi)施(shi)“绿色(se)通(tong)道”、“容缺(que)受理”等(deng)行(xing)(xing)政(zheng)(zheng)(zheng)审(shen)批(pi)(pi)便利(li)服务措施(shi)。对(dui)符合开辟绿色(se)通(tong)道的(de)(de)行(xing)(xing)政(zheng)(zheng)(zheng)相对(dui)人,通(tong)过召(zhao)开协调(diao)会、提前介入(ru)等(deng)方式先行(xing)(xing)受理,加快办理速度。(县行(xing)(xing)政(zheng)(zheng)(zheng)审(shen)批(pi)(pi)服务中心牵头(tou),各(ge)部门按职责(ze)分工(gong)负(fu)责(ze))

3.优(you)先(xian)提(ti)供(gong)便利(li)化公共(gong)服(fu)务(wu)。通(tong)过查(cha)询省、市(shi)信(xin)(xin)用(yong)(yong)信(xin)(xin)息共(gong)享平(ping)台信(xin)(xin)用(yong)(yong)信(xin)(xin)息或使用(yong)(yong)第三方(fang)信(xin)(xin)用(yong)(yong)服(fu)务(wu)机构(gou)提(ti)供(gong)的信(xin)(xin)用(yong)(yong)报告等方(fang)式,在实(shi)施财政(zheng)性资(zi)金项(xiang)目(mu)安(an)排、招商(shang)引资(zi)配套(tao)优(you)惠政(zheng)策等各类政(zheng)府优(you)惠政(zheng)策中(zhong),优(you)先(xian)考(kao)虑守(shou)信(xin)(xin)市(shi)场主体(ti)。对守(shou)信(xin)(xin)主体(ti)给予重点(dian)支持和优(you)先(xian)便利(li)。(县发改局、县财政(zheng)局、县国税(shui)局、县地税(shui)局、县市(shi)场监(jian)管(guan)局分别牵头,各部门按(an)职责分工负责)

4.创新守信(xin)(xin)企(qi)(qi)业(ye)(ye)行政监(jian)(jian)(jian)管。县(xian)(xian)(xian)市(shi)场(chang)监(jian)(jian)(jian)管部门在企(qi)(qi)业(ye)(ye)监(jian)(jian)(jian)管、食品(pin)药品(pin)安(an)(an)全、消费安(an)(an)全、安(an)(an)全生产等领域,根据监(jian)(jian)(jian)管对(dui)象(xiang)的信(xin)(xin)用(yong)记(ji)录和信(xin)(xin)用(yong)评价分类,运用(yong)信(xin)(xin)息化手(shou)段,创新市(shi)场(chang)经营(ying)交易(yi)行为监(jian)(jian)(jian)管方(fang)式,为市(shi)场(chang)主体提供便(bian)利服务。依据国(guo)家(jia)和省、市(shi)明(ming)确的守信(xin)(xin)激励(li)手(shou)段,制定(ding)本部门事中、事后监(jian)(jian)(jian)管实(shi)施(shi)方(fang)案(an),对(dui)符合一定(ding)条件(jian)的守信(xin)(xin)企(qi)(qi)业(ye)(ye),优(you)化日常检查和专项检查频次。(县(xian)(xian)(xian)市(shi)场(chang)监(jian)(jian)(jian)管局(ju)、县(xian)(xian)(xian)安(an)(an)监(jian)(jian)(jian)局(ju)、县(xian)(xian)(xian)商(shang)务粮食局(ju)分别牵头(tou),各部门按职责分工负责)

5.提供市(shi)(shi)场优惠(hui)(hui)服(fu)务(wu)。鼓(gu)励有(you)关部门和(he)(he)金融机构(gou)、商业销(xiao)售机构(gou)等市(shi)(shi)场服(fu)务(wu)机构(gou)大(da)力开发“信(xin)(xin)易(yi)贷”、“信(xin)(xin)易(yi)债”、“税易(yi)贷”等守信(xin)(xin)激励产品,规范提供市(shi)(shi)场主体信(xin)(xin)用信(xin)(xin)息、信(xin)(xin)用积分(fen)和(he)(he)信(xin)(xin)用评价结果,对守信(xin)(xin)市(shi)(shi)场主体给予优惠(hui)(hui)和(he)(he)便利,使守信(xin)(xin)者获得更多机会(hui)和(he)(he)实惠(hui)(hui)。(县(xian)人(ren)民银(yin)行、县(xian)银(yin)监(jian)局(ju)、县(xian)国税局(ju)、县(xian)地税局(ju)分(fen)别牵(qian)头(tou),各部门按(an)职责(ze)分(fen)工负(fu)责(ze))

6.多(duo)渠道推(tui)介(jie)守(shou)信(xin)(xin)(xin)(xin)(xin)市场(chang)(chang)主体(ti)(ti)。各(ge)部(bu)门(men)应及时(shi)将守(shou)信(xin)(xin)(xin)(xin)(xin)市场(chang)(chang)主体(ti)(ti)优良信(xin)(xin)(xin)(xin)(xin)用(yong)信(xin)(xin)(xin)(xin)(xin)息报送(song)至县(xian)(xian)信(xin)(xin)(xin)(xin)(xin)用(yong)办,由(you)县(xian)(xian)信(xin)(xin)(xin)(xin)(xin)用(yong)办向上级主管部(bu)门(men)报送(song)在“信(xin)(xin)(xin)(xin)(xin)用(yong)哈尔(er)滨”网站进行(xing)公示,并在会展、银企对接等(deng)活动(dong)中重(zhong)点推(tui)介(jie)守(shou)信(xin)(xin)(xin)(xin)(xin)企业,让(rang)诚(cheng)信(xin)(xin)(xin)(xin)(xin)成为市场(chang)(chang)配置资(zi)源的(de)重(zhong)要考量(liang)因素(su)。大(da)(da)力宣(xuan)(xuan)传(chuan)守(shou)信(xin)(xin)(xin)(xin)(xin)企业、群(qun)体(ti)(ti)和个人(ren),积极评选诚(cheng)实(shi)守(shou)信(xin)(xin)(xin)(xin)(xin)道德模范(fan)。支持征信(xin)(xin)(xin)(xin)(xin)机构(gou)加强对市场(chang)(chang)主体(ti)(ti)正面信(xin)(xin)(xin)(xin)(xin)息的(de)采集,在失信(xin)(xin)(xin)(xin)(xin)问题反映较为集中的(de)行(xing)业领域,加大(da)(da)对守(shou)信(xin)(xin)(xin)(xin)(xin)者的(de)激励性评分(fen)比重(zhong)。推(tui)动(dong)行(xing)业协会商(shang)会加强信(xin)(xin)(xin)(xin)(xin)用(yong)建设(she)和行(xing)业自(zi)律,表彰守(shou)信(xin)(xin)(xin)(xin)(xin)会员。引导企业主动(dong)发布综合信(xin)(xin)(xin)(xin)(xin)用(yong)承诺或产品服务(wu)质量(liang)等(deng)专项承诺,开展产品服务(wu)标准等(deng)自(zi)我声明(ming)公开,主动(dong)接受(shou)社会监督。(县(xian)(xian)委宣(xuan)(xuan)传(chuan)部(bu)、县(xian)(xian)文明(ming)办、县(xian)(xian)住建局、县(xian)(xian)国土资(zi)源局、县(xian)(xian)市场(chang)(chang)监管局、县(xian)(xian)旅游局、县(xian)(xian)民(min)政局分(fen)别牵头,各(ge)部(bu)门(men)按职责分(fen)工负责)

(二)健全完善(shan)失信联合惩戒机(ji)制

7.对重(zhong)(zhong)(zhong)点领(ling)域(yu)严(yan)(yan)(yan)重(zhong)(zhong)(zhong)失(shi)(shi)(shi)信(xin)行(xing)(xing)(xing)(xing)(xing)(xing)为(wei)实施(shi)联合惩(cheng)戒(jie)。2018年3月底前,各部门和(he)(he)(he)社(she)(she)会(hui)(hui)组(zu)织(zhi)要制(zhi)定(ding)本领(ling)域(yu)失(shi)(shi)(shi)信(xin)行(xing)(xing)(xing)(xing)(xing)(xing)为(wei)认定(ding)、等(deng)级(ji)划分和(he)(he)(he)分类(lei)监管实施(shi)措施(shi),对失(shi)(shi)(shi)信(xin)行(xing)(xing)(xing)(xing)(xing)(xing)为(wei)进行(xing)(xing)(xing)(xing)(xing)(xing)处理(li)和(he)(he)(he)评价(jia),并(bing)通(tong)过市(shi)信(xin)用(yong)(yong)(yong)(yong)信(xin)息共享平台实现信(xin)息共享,推(tui)动其他(ta)部门和(he)(he)(he)社(she)(she)会(hui)(hui)组(zu)织(zhi)依(yi)法(fa)依(yi)规(gui)对重(zhong)(zhong)(zhong)点领(ling)域(yu)严(yan)(yan)(yan)重(zhong)(zhong)(zhong)失(shi)(shi)(shi)信(xin)行(xing)(xing)(xing)(xing)(xing)(xing)为(wei)采取联合惩(cheng)戒(jie)措施(shi)。一是严(yan)(yan)(yan)重(zhong)(zhong)(zhong)危害人民群众身体健康(kang)和(he)(he)(he)生命安(an)(an)全(quan)(quan)的(de)行(xing)(xing)(xing)(xing)(xing)(xing)为(wei),包(bao)括(kuo)食品药品、生态环境、工程质(zhi)量、安(an)(an)全(quan)(quan)生产、消(xiao)防(fang)(fang)安(an)(an)全(quan)(quan)、强制(zhi)性产品认证等(deng)领(ling)域(yu)的(de)严(yan)(yan)(yan)重(zhong)(zhong)(zhong)失(shi)(shi)(shi)信(xin)行(xing)(xing)(xing)(xing)(xing)(xing)为(wei)。二是严(yan)(yan)(yan)重(zhong)(zhong)(zhong)破(po)坏市(shi)场(chang)秩(zhi)序和(he)(he)(he)社(she)(she)会(hui)(hui)正(zheng)常秩(zhi)序的(de)行(xing)(xing)(xing)(xing)(xing)(xing)为(wei),包(bao)括(kuo)贿赂、逃税(shui)骗(pian)税(shui)、套取骗(pian)取住房公(gong)积金(jin)、故意(yi)拖欠(qian)(qian)或(huo)少(shao)缴(jiao)以(yi)及违(wei)规(gui)使用(yong)(yong)(yong)(yong)各类(lei)资(zi)金(jin)(基金(jin))、恶(e)(e)意(yi)逃废(fei)债务(wu)、恶(e)(e)意(yi)拖欠(qian)(qian)货(huo)款或(huo)服(fu)务(wu)费(fei)、恶(e)(e)意(yi)欠(qian)(qian)薪、非法(fa)集资(zi)、不(bu)(bu)(bu)正(zheng)当竞争、合同(tong)欺诈、传销、无(wu)证照(zhao)经营、制(zhi)售(shou)假(jia)冒伪劣产品和(he)(he)(he)故意(yi)侵犯知识产权、出(chu)借(jie)和(he)(he)(he)借(jie)用(yong)(yong)(yong)(yong)资(zi)质(zhi)投(tou)标(biao)、虚(xu)假(jia)投(tou)标(biao)、围标(biao)串标(biao)、虚(xu)假(jia)广告(gao)、侵害消(xiao)费(fei)者或(huo)证券(quan)期货(huo)投(tou)资(zi)者合法(fa)权益、严(yan)(yan)(yan)重(zhong)(zhong)(zhong)破(po)坏网络空(kong)间传播(bo)秩(zhi)序、聚众扰乱社(she)(she)会(hui)(hui)秩(zhi)序等(deng)严(yan)(yan)(yan)重(zhong)(zhong)(zhong)失(shi)(shi)(shi)信(xin)行(xing)(xing)(xing)(xing)(xing)(xing)为(wei)。三(san)是拒(ju)(ju)不(bu)(bu)(bu)履行(xing)(xing)(xing)(xing)(xing)(xing)法(fa)定(ding)义务(wu),严(yan)(yan)(yan)重(zhong)(zhong)(zhong)影(ying)响司(si)法(fa)机关、行(xing)(xing)(xing)(xing)(xing)(xing)政(zheng)机关公(gong)信(xin)力的(de)行(xing)(xing)(xing)(xing)(xing)(xing)为(wei),包(bao)括(kuo)当事(shi)人在司(si)法(fa)机关、行(xing)(xing)(xing)(xing)(xing)(xing)政(zheng)机关作出(chu)判决或(huo)决定(ding)后,有(you)履行(xing)(xing)(xing)(xing)(xing)(xing)能力但拒(ju)(ju)不(bu)(bu)(bu)履行(xing)(xing)(xing)(xing)(xing)(xing)、逃避(bi)执(zhi)行(xing)(xing)(xing)(xing)(xing)(xing)等(deng)严(yan)(yan)(yan)重(zhong)(zhong)(zhong)失(shi)(shi)(shi)信(xin)行(xing)(xing)(xing)(xing)(xing)(xing)为(wei)。四是拒(ju)(ju)不(bu)(bu)(bu)履行(xing)(xing)(xing)(xing)(xing)(xing)国防(fang)(fang)义务(wu),拒(ju)(ju)绝、逃避(bi)兵役,拒(ju)(ju)绝、拖延民用(yong)(yong)(yong)(yong)资(zi)源征用(yong)(yong)(yong)(yong)或(huo)者阻(zu)碍对被征用(yong)(yong)(yong)(yong)的(de)民用(yong)(yong)(yong)(yong)资(zi)源进行(xing)(xing)(xing)(xing)(xing)(xing)改造(zao),危害国防(fang)(fang)利(li)益,破(po)坏国防(fang)(fang)设施(shi)等(deng)行(xing)(xing)(xing)(xing)(xing)(xing)为(wei)。(各部门按职(zhi)责(ze)(ze)分工负责(ze)(ze))

8.对(dui)(dui)(dui)失(shi)(shi)(shi)信(xin)(xin)行(xing)为实施(shi)行(xing)政(zheng)性约束和(he)(he)(he)惩戒(jie)。各部(bu)门将严(yan)(yan)(yan)重(zhong)(zhong)失(shi)(shi)(shi)信(xin)(xin)主体列(lie)为重(zhong)(zhong)点监(jian)管对(dui)(dui)(dui)象,并(bing)(bing)根据(ju)监(jian)管职权和(he)(he)(he)国(guo)家、省、市(shi)有关部(bu)署,于2018年3月底(di)前制(zhi)(zhi)(zhi)定(ding)、发布针(zhen)对(dui)(dui)(dui)严(yan)(yan)(yan)重(zhong)(zhong)失(shi)(shi)(shi)信(xin)(xin)主体的行(xing)政(zheng)性约束和(he)(he)(he)惩戒(jie)具体措施(shi),明确实施(shi)主体、工(gong)(gong)作(zuo)流程等(deng),依(yi)法依(yi)规实施(shi)惩戒(jie)。从(cong)(cong)严(yan)(yan)(yan)审(shen)核(he)行(xing)政(zheng)许(xu)(xu)可审(shen)批项目,从(cong)(cong)严(yan)(yan)(yan)控制(zhi)(zhi)(zhi)生产许(xu)(xu)可证发放,限制(zhi)(zhi)(zhi)新增(zeng)项目审(shen)批、核(he)准,限制(zhi)(zhi)(zhi)发起设立或(huo)参股金融(rong)机构以及小额贷款公(gong)(gong)司、融(rong)资(zi)担(dan)保公(gong)(gong)司、创业(ye)投资(zi)企(qi)业(ye)、互联(lian)网融(rong)资(zi)平台等(deng)机构,限制(zhi)(zhi)(zhi)从(cong)(cong)事互联(lian)网信(xin)(xin)息服(fu)务等(deng)。严(yan)(yan)(yan)格限制(zhi)(zhi)(zhi)申(shen)请财政(zheng)性资(zi)金项目,限制(zhi)(zhi)(zhi)参与(yu)有关公(gong)(gong)共资(zi)源交(jiao)易活动,限制(zhi)(zhi)(zhi)参与(yu)基础设施(shi)和(he)(he)(he)公(gong)(gong)用事业(ye)特(te)许(xu)(xu)经营。对(dui)(dui)(dui)严(yan)(yan)(yan)重(zhong)(zhong)失(shi)(shi)(shi)信(xin)(xin)企(qi)业(ye)及其法定(ding)代表人(ren)(ren)、主要负(fu)责(ze)人(ren)(ren)和(he)(he)(he)对(dui)(dui)(dui)失(shi)(shi)(shi)信(xin)(xin)行(xing)为负(fu)有直接责(ze)任的注(zhu)册执业(ye)人(ren)(ren)员(yuan)等(deng),实施(shi)市(shi)场(chang)和(he)(he)(he)行(xing)业(ye)禁入措施(shi)。及时撤(che)销严(yan)(yan)(yan)重(zhong)(zhong)失(shi)(shi)(shi)信(xin)(xin)企(qi)业(ye)及其法定(ding)代表人(ren)(ren)、负(fu)责(ze)人(ren)(ren)、高级管理人(ren)(ren)员(yuan)和(he)(he)(he)对(dui)(dui)(dui)失(shi)(shi)(shi)信(xin)(xin)行(xing)为负(fu)有直接责(ze)任的董事、股东(dong)等(deng)人(ren)(ren)员(yuan)的荣誉称号,并(bing)(bing)取消其参加评先(xian)评优(you)资(zi)格。(县发改局、县财政(zheng)局、县工(gong)(gong)信(xin)(xin)局、县市(shi)场(chang)监(jian)管局、县住建局、县商务粮食局、县交(jiao)通运输局分别牵头,各部(bu)门按(an)职责(ze)分工(gong)(gong)负(fu)责(ze))

9.对失信(xin)(xin)(xin)行(xing)(xing)为(wei)实(shi)施(shi)(shi)市(shi)(shi)场(chang)性约(yue)束和(he)(he)惩戒(jie)。各(ge)部(bu)门和(he)(he)社(she)会(hui)组织要以统一(yi)社(she)会(hui)信(xin)(xin)(xin)用(yong)代码为(wei)索引,依托“信(xin)(xin)(xin)用(yong)哈尔滨”网站(zhan)等,及(ji)时公开披露严(yan)重(zhong)失信(xin)(xin)(xin)主(zhu)(zhu)体相关信(xin)(xin)(xin)息,为(wei)市(shi)(shi)场(chang)识别(bie)失信(xin)(xin)(xin)行(xing)(xing)为(wei)和(he)(he)防范信(xin)(xin)(xin)用(yong)风险(xian)提(ti)供(gong)便利(li)。督促有(you)关企业和(he)(he)个人履行(xing)(xing)法定义务,对有(you)履行(xing)(xing)能力但拒不(bu)履行(xing)(xing)的严(yan)重(zhong)失信(xin)(xin)(xin)主(zhu)(zhu)体实(shi)施(shi)(shi)限制(zhi)出境和(he)(he)限制(zhi)购买不(bu)动产、旅(lv)(lv)游度假(jia)、入住星级以上宾(bin)馆及(ji)其(qi)(qi)他高消费(fei)行(xing)(xing)为(wei)等措施(shi)(shi);将不(bu)良信(xin)(xin)(xin)息上传国家和(he)(he)省、市(shi)(shi)信(xin)(xin)(xin)用(yong)信(xin)(xin)(xin)息共享平台,提(ti)请采(cai)(cai)取限制(zhi)其(qi)(qi)乘坐飞(fei)机、高等级列车和(he)(he)席次等措施(shi)(shi)。支持征信(xin)(xin)(xin)机构采(cai)(cai)集严(yan)重(zhong)失信(xin)(xin)(xin)行(xing)(xing)为(wei)信(xin)(xin)(xin)息,纳入市(shi)(shi)场(chang)主(zhu)(zhu)体信(xin)(xin)(xin)用(yong)记录和(he)(he)信(xin)(xin)(xin)用(yong)报告。引导商业银行(xing)(xing)、证券期货经(jing)营机构、保(bao)险(xian)公司(si)等金融机构按(an)(an)照风险(xian)定价(jia)原则,对严(yan)重(zhong)失信(xin)(xin)(xin)主(zhu)(zhu)体提(ti)高贷款(kuan)(kuan)利(li)率和(he)(he)财产保(bao)险(xian)费(fei)率,或(huo)者限制(zhi)向(xiang)其(qi)(qi)提(ti)供(gong)贷款(kuan)(kuan)、保(bao)荐(jian)、承销、保(bao)险(xian)等服(fu)务。(县人民银行(xing)(xing)、县市(shi)(shi)场(chang)监(jian)管局(ju)、县民政(zheng)局(ju)、县国土资源局(ju)、县住建(jian)局(ju)、县旅(lv)(lv)游局(ju)、县银监(jian)局(ju)分别(bie)牵(qian)头,各(ge)部(bu)门按(an)(an)职(zhi)责分工(gong)负责)

10.对失(shi)信(xin)(xin)行(xing)(xing)(xing)为实(shi)(shi)施(shi)行(xing)(xing)(xing)业(ye)(ye)(ye)性约束和(he)惩戒(jie)。督促各级(ji)(ji)行(xing)(xing)(xing)业(ye)(ye)(ye)协(xie)会(hui)(hui)商(shang)(shang)会(hui)(hui)加强诚信(xin)(xin)自(zi)律建设,指导行(xing)(xing)(xing)业(ye)(ye)(ye)协(xie)会(hui)(hui)商(shang)(shang)会(hui)(hui)健全行(xing)(xing)(xing)业(ye)(ye)(ye)自(zi)律公约和(he)职业(ye)(ye)(ye)道德准(zhun)则,推动行(xing)(xing)(xing)业(ye)(ye)(ye)信(xin)(xin)用(yong)建设。引导行(xing)(xing)(xing)业(ye)(ye)(ye)协(xie)会(hui)(hui)商(shang)(shang)会(hui)(hui)依(yi)法(fa)、及时、准(zhun)确记(ji)录会(hui)(hui)员(yuan)严重(zhong)失(shi)信(xin)(xin)行(xing)(xing)(xing)为,并(bing)将相关信(xin)(xin)息纳入会(hui)(hui)员(yuan)信(xin)(xin)用(yong)档案(an),依(yi)托行(xing)(xing)(xing)业(ye)(ye)(ye)主管(guan)部门信(xin)(xin)息系统、市(shi)信(xin)(xin)用(yong)信(xin)(xin)息共享平(ping)台等(deng)实(shi)(shi)现共享。鼓励行(xing)(xing)(xing)业(ye)(ye)(ye)协(xie)会(hui)(hui)商(shang)(shang)会(hui)(hui)与(yu)有(you)资质的第三方信(xin)(xin)用(yong)服务(wu)机构合作,遵循(xun)自(zi)愿(yuan)参加原则,依(yi)法(fa)依(yi)规开展(zhan)会(hui)(hui)员(yuan)企业(ye)(ye)(ye)信(xin)(xin)用(yong)等(deng)级(ji)(ji)评价。支持行(xing)(xing)(xing)业(ye)(ye)(ye)协(xie)会(hui)(hui)商(shang)(shang)会(hui)(hui)按照(zhao)行(xing)(xing)(xing)业(ye)(ye)(ye)标准(zhun)、行(xing)(xing)(xing)规、行(xing)(xing)(xing)约等(deng),视情节轻(qing)重(zhong)对失(shi)信(xin)(xin)会(hui)(hui)员(yuan)实(shi)(shi)行(xing)(xing)(xing)警(jing)告、行(xing)(xing)(xing)业(ye)(ye)(ye)内通报批评、公开谴责(ze)、不(bu)予接(jie)纳、劝退(tui)等(deng)惩戒(jie)措(cuo)施(shi)。(县(xian)民政局牵头,各部门按职责(ze)分工负责(ze))

11.对(dui)失(shi)信(xin)(xin)行(xing)(xing)为(wei)实施社会(hui)性(xing)约束和惩(cheng)戒(jie)。充分(fen)发挥公(gong)(gong)益慈(ci)善类(lei)社会(hui)组(zu)织、民办非企(qi)业(ye)单位等(deng)(deng)各类(lei)社会(hui)组(zu)织作(zuo)用,引导社会(hui)力量广泛参与失(shi)信(xin)(xin)联合惩(cheng)戒(jie)。支持有(you)关社会(hui)组(zu)织依法(fa)对(dui)污(wu)染环境、侵(qin)害消费者(zhe)或公(gong)(gong)众投(tou)资者(zhe)合法(fa)权益等(deng)(deng)群体性(xing)侵(qin)权行(xing)(xing)为(wei)提起公(gong)(gong)益诉讼。鼓励公(gong)(gong)正、独立(li)、有(you)条(tiao)件的社会(hui)机构开展失(shi)信(xin)(xin)行(xing)(xing)为(wei)大(da)数据(ju)舆情监(jian)测,编制(zhi)发布本行(xing)(xing)业(ye)信(xin)(xin)用分(fen)析报告。(县公(gong)(gong)安局(ju)、县民政局(ju)、县环保(bao)局(ju)、县市场监(jian)管局(ju)分(fen)别牵头,各部(bu)门(men)按职(zhi)责(ze)分(fen)工负责(ze))。

12.实施(shi)个(ge)人(ren)(ren)失(shi)信(xin)(xin)(xin)行(xing)为(wei)联合惩(cheng)(cheng)戒(jie)(jie)。各(ge)部门(men)要逐步建立健全个(ge)人(ren)(ren)信(xin)(xin)(xin)用(yong)档案(an),加强(qiang)个(ge)人(ren)(ren)信(xin)(xin)(xin)用(yong)信(xin)(xin)(xin)息记(ji)(ji)录和归集,逐步推动(dong)失(shi)信(xin)(xin)(xin)联合惩(cheng)(cheng)戒(jie)(jie)措(cuo)施(shi)落(luo)实到人(ren)(ren)。对企事(shi)业(ye)单(dan)(dan)位严(yan)重失(shi)信(xin)(xin)(xin)行(xing)为(wei),在记(ji)(ji)入企事(shi)业(ye)单(dan)(dan)位信(xin)(xin)(xin)用(yong)记(ji)(ji)录的(de)(de)同时(shi),记(ji)(ji)入其(qi)法(fa)定代表人(ren)(ren)、主要负(fu)责(ze)人(ren)(ren)和其(qi)他负(fu)有直接责(ze)任人(ren)(ren)员(yuan)的(de)(de)个(ge)人(ren)(ren)信(xin)(xin)(xin)用(yong)档案(an)。在对失(shi)信(xin)(xin)(xin)企事(shi)业(ye)单(dan)(dan)位进行(xing)联合惩(cheng)(cheng)戒(jie)(jie)的(de)(de)同时(shi),依法(fa)依规(gui)对相(xiang)关责(ze)任人(ren)(ren)员(yuan)采(cai)取相(xiang)应的(de)(de)联合惩(cheng)(cheng)戒(jie)(jie)措(cuo)施(shi)。(各(ge)部门(men)按(an)职(zhi)责(ze)分工(gong)负(fu)责(ze))

14.完善信用(yong)(yong)“红(hong)黑名(ming)(ming)(ming)单(dan)”制(zhi)度。建立(li)并完善各领域(yu)诚信典(dian)型“红(hong)名(ming)(ming)(ming)单(dan)”制(zhi)度和严重(zhong)失信主体“黑名(ming)(ming)(ming)单(dan)”制(zhi)度,依法依规(gui)(gui)规(gui)(gui)范“红(hong)黑名(ming)(ming)(ming)单(dan)”产生(sheng)和发布行(xing)为(wei),建立(li)健全(quan)退(tui)出(chu)机(ji)制(zhi)。其(qi)中(zhong),产品质量、环境保护、税收(shou)等重(zhong)点领域(yu)2018年3月(yue)底前实(shi)施。在保证独立(li)、公(gong)正、客(ke)观前提下,鼓励有关(guan)群众(zhong)团体、金融机(ji)构、征信机(ji)构、评级(ji)机(ji)构、行(xing)业(ye)协会(hui)商会(hui)等制(zhi)定合理的信用(yong)(yong)评价(jia)办法,将产生(sheng)的“红(hong)黑名(ming)(ming)(ming)单(dan)”信息依托市信用(yong)(yong)信息共享平台在“信用(yong)(yong)哈尔滨(bin)”网站发布,供政府部门(men)和社会(hui)参考使用(yong)(yong)。(县(xian)(xian)(xian)市场监管局(ju)、县(xian)(xian)(xian)环保局(ju)、县(xian)(xian)(xian)国税局(ju)、县(xian)(xian)(xian)地税局(ju)分别牵头,各部门(men)按职责(ze)分工负责(ze))

15.建立激(ji)励(li)(li)和(he)(he)惩(cheng)(cheng)戒(jie)(jie)(jie)措(cuo)施(shi)清单制度。各部门要全面梳理(li)法规和(he)(he)政(zheng)(zheng)策明确的(de)联合激(ji)励(li)(li)和(he)(he)惩(cheng)(cheng)戒(jie)(jie)(jie)事项,建立守(shou)信(xin)(xin)联合激(ji)励(li)(li)和(he)(he)失信(xin)(xin)联合惩(cheng)(cheng)戒(jie)(jie)(jie)的(de)强(qiang)制性(xing)、推(tui)(tui)荐性(xing)两类措(cuo)施(shi)清单。强(qiang)制性(xing)措(cuo)施(shi)是(shi)指(zhi)依法必须联合执行的(de)激(ji)励(li)(li)和(he)(he)惩(cheng)(cheng)戒(jie)(jie)(jie)措(cuo)施(shi);推(tui)(tui)荐性(xing)措(cuo)施(shi)是(shi)指(zhi)符(fu)合褒扬守(shou)信(xin)(xin)、惩(cheng)(cheng)戒(jie)(jie)(jie)失信(xin)(xin)政(zheng)(zheng)策导向,可根据实(shi)(shi)际情况实(shi)(shi)施(shi)的(de)措(cuo)施(shi)。县社会信(xin)(xin)用(yong)体系建设牵头(tou)单位于2018年(nian)3月底(di)前(qian)汇总(zong)并完善两级激(ji)励(li)(li)和(he)(he)惩(cheng)(cheng)戒(jie)(jie)(jie)措(cuo)施(shi)清单,实(shi)(shi)行动态(tai)更新,作为实(shi)(shi)施(shi)联动奖惩(cheng)(cheng)依据。(各部门按职(zhi)责(ze)分工负责(ze))

16.建立健全信(xin)(xin)用(yong)修(xiu)复机制(zhi)。各(ge)领域(yu)联合(he)惩戒(jie)措施发起单位和实(shi)施单位应按(an)照法律法规(gui)、政策规(gui)定明确各(ge)类失(shi)信(xin)(xin)行(xing)(xing)(xing)为的(de)(de)联合(he)惩戒(jie)期(qi)限。对(dui)在规(gui)定期(qi)限内纠正失(shi)信(xin)(xin)行(xing)(xing)(xing)为、消除不(bu)良影响的(de)(de),不(bu)再(zai)作为联合(he)惩戒(jie)对(dui)象。2018年4月(yue)底前,各(ge)有(you)关部(bu)门(men)要明确本部(bu)门(men)、本行(xing)(xing)(xing)业(ye)信(xin)(xin)用(yong)修(xiu)复条件和程序,建立有(you)利于(yu)自(zi)(zi)我纠错、主(zhu)动自(zi)(zi)新的(de)(de)社(she)会鼓励与关爱机制(zhi)。利用(yong)教育(yu)培训、强化指导等手(shou)段,支(zhi)持(chi)有(you)失(shi)信(xin)(xin)行(xing)(xing)(xing)为的(de)(de)个人(ren)通过社(she)会公益服务等方式修(xiu)复个人(ren)信(xin)(xin)用(yong),重塑诚实(shi)守信(xin)(xin)形象。(各(ge)部(bu)门(men)按(an)职责(ze)分工负责(ze))

17.建(jian)立健全信(xin)(xin)用主体权益(yi)(yi)保护机制(zhi)。各(ge)部门在执(zhi)行失信(xin)(xin)联合(he)惩戒措(cuo)施(shi)时主动发现(xian)、经信(xin)(xin)用主体提(ti)(ti)出(chu)异议(yi)申请或投(tou)诉发现(xian)信(xin)(xin)息(xi)不(bu)实(shi)(shi)(shi)的,应(ying)及时告知信(xin)(xin)息(xi)提(ti)(ti)供(gong)单(dan)位核(he)(he)实(shi)(shi)(shi),信(xin)(xin)息(xi)提(ti)(ti)供(gong)单(dan)位应(ying)尽快核(he)(he)实(shi)(shi)(shi)并反馈。联合(he)惩戒措(cuo)施(shi)在信(xin)(xin)息(xi)核(he)(he)实(shi)(shi)(shi)期间暂不(bu)执(zhi)行。经核(he)(he)实(shi)(shi)(shi)有误的信(xin)(xin)息(xi)应(ying)及时更正(zheng)或撤销。对因错(cuo)误采(cai)取(qu)联合(he)惩戒措(cuo)施(shi)损害有关(guan)主体合(he)法权益(yi)(yi)的,有关(guan)部门和单(dan)位应(ying)积极采(cai)取(qu)措(cuo)施(shi)恢复其信(xin)(xin)誉,消(xiao)除不(bu)良影响。支持有关(guan)主体通过行政复议(yi)、行政诉讼等方式维护自(zi)身合(he)法权益(yi)(yi)。(各(ge)部门按职责分工负责)

18.建立(li)跟(gen)(gen)踪问效机制。依托市信用(yong)信息共(gong)享(xiang)平台,建立(li)健全(quan)信用(yong)联合奖惩跟(gen)(gen)踪、监测、统计及评估机制,并(bing)建立(li)相应的督查(cha)、考(kao)核制度。对信用(yong)信息归集、共(gong)享(xiang)和激(ji)励惩戒措(cuo)施落实不力的部门,将采取适当方式进行通报和督促整改(gai)。(县(xian)信用(yong)办牵头,各部门按职(zhi)责分工负责)

(四)加强标准制(zhi)度和(he)诚信文化建(jian)设

19.建立健(jian)全标准制度(du)。加(jia)快信(xin)用制度(du)建设。指导守信(xin)联合(he)激励和(he)失(shi)信(xin)联合(he)惩戒工作,按(an)(an)照强化信(xin)用约(yue)束(shu)和(he)协同监管要(yao)(yao)求,认真(zhen)贯彻落实国家和(he)省、市有(you)关要(yao)(yao)求,制定(ding)信(xin)用信(xin)息归(gui)集、共享(xiang)、公开、应用和(he)信(xin)用评价、信(xin)用分类管理等制度(du)措(cuo)施,推进联合(he)奖惩步(bu)入标准化、制度(du)化和(he)法(fa)制化轨道。(县信(xin)用办牵头(tou),各部(bu)门按(an)(an)职责分工负责)

20.加(jia)强(qiang)诚(cheng)信(xin)(xin)(xin)教(jiao)(jiao)育(yu)和(he)(he)(he)文化(hua)建设。践行(xing)(xing)社(she)(she)会(hui)(hui)主(zhu)义(yi)核心价(jia)值(zhi)观,秉持现代(dai)市(shi)场经济的(de)契约精神,把宣(xuan)传(chuan)(chuan)教(jiao)(jiao)育(yu)与诚(cheng)信(xin)(xin)(xin)文化(hua)结合起来提升(sheng)公民诚(cheng)信(xin)(xin)(xin)意识(shi)和(he)(he)(he)社(she)(she)会(hui)(hui)诚(cheng)信(xin)(xin)(xin)水平。开展“百城万店无(wu)假货”、“诚(cheng)信(xin)(xin)(xin)做产品(pin)”、3.l5消(xiao)费者权益(yi)日和(he)(he)(he)食品(pin)安(an)全宣(xuan)传(chuan)(chuan)周等(deng)主(zhu)题活(huo)动,引导广大社(she)(she)会(hui)(hui)信(xin)(xin)(xin)用(yong)主(zhu)体(ti)树立(li)“诚(cheng)信(xin)(xin)(xin)兴商”理念,多渠道(dao)宣(xuan)传(chuan)(chuan)诚(cheng)信(xin)(xin)(xin)企业、群体(ti)和(he)(he)(he)个人(ren)(ren)。加(jia)大对守信(xin)(xin)(xin)联合激励和(he)(he)(he)失信(xin)(xin)(xin)联合惩戒的(de)宣(xuan)传(chuan)(chuan)报道(dao)和(he)(he)(he)案例(li)剖析力(li)度,利用(yong)报刊、广播(bo)、电(dian)(dian)视、网络等(deng)媒体(ti)依法曝光社(she)(she)会(hui)(hui)影响恶劣、情节严重(zhong)的(de)失信(xin)(xin)(xin)案件(jian),开展群众评议(yi)活(huo)动。披露失信(xin)(xin)(xin)败德(de)行(xing)(xing)为,形(xing)成对严重(zhong)失信(xin)(xin)(xin)行(xing)(xing)为的(de)舆(yu)论(lun)压力(li)和(he)(he)(he)道(dao)德(de)约束。开展对公职人(ren)(ren)员(yuan)、企业负责人(ren)(ren)、会(hui)(hui)计审计人(ren)(ren)员(yuan)、保险经纪人(ren)(ren)、导游和(he)(he)(he)学(xue)生等(deng)重(zhong)点人(ren)(ren)群的(de)职业道(dao)德(de)建设,利用(yong)单(dan)位、社(she)(she)区、学(xue)校、家(jia)庭(ting),加(jia)强(qiang)对失信(xin)(xin)(xin)个人(ren)(ren)的(de)教(jiao)(jiao)育(yu)和(he)(he)(he)帮助。(县委(wei)宣(xuan)传(chuan)(chuan)部、县文明办、县电(dian)(dian)视台分别牵头,各(ge)部门按(an)职责分工负责)

  三、保障措施(shi)

(一)强化(hua)组织实(shi)施。各部门要(yao)按照本《意见》要(yao)求,切(qie)实(shi)加强组织领(ling)导,明确责(ze)任(ren)分工(gong),细(xi)化(hua)目标(biao)任(ren)务(wu),确保(bao)将联(lian)合(he)奖惩各项工(gong)作落实(shi)到位。

(二)完善配套制(zhi)度。各部门要加快制(zhi)定(ding)本(ben)部门、本(ben)行业“红黑名单”发布、守(shou)信(xin)联(lian)合激(ji)励(li)(li)和(he)失信(xin)联(lian)合惩戒等制(zhi)度措施,积(ji)极发起和(he)配合其他单位做好守(shou)信(xin)联(lian)合激(ji)励(li)(li)和(he)失信(xin)联(lian)合惩戒工作(zuo)。

(三)加强指导协调(diao)。县信(xin)用办要加大指导力度,积极(ji)帮(bang)助各部门(men)协调(diao)建立联(lian)合奖惩(cheng)机制,各部门(men)要主动作为(wei),扎实推动本部门(men)、本行(xing)业守信(xin)联(lian)合激(ji)励和失信(xin)联(lian)合惩(cheng)戒工作。

(四(si))健(jian)全报(bao)送(song)机制。各部门要(yao)按照《关于建立我市报(bao)送(song)守(shou)信(xin)激励(li)和(he)失信(xin)惩戒典型案例(li)工(gong)作机制的通(tong)知》(哈(ha)诚(cheng)办发(fa)〔2017〕1号)要(yao)求,建立常态化报(bao)送(song)机制,负责组织、筛选和(he)认定本部门、本行业守(shou)信(xin)失信(xin)典型案例(li),实(shi)时或至少每月20日前向县信(xin)用办报(bao)送(song),依(yi)法(fa)依(yi)规公开。

(五)加(jia)大(da)考核力(li)度。将本《意见(jian)》明确的(de)工(gong)作(zuo)任务纳入年度县直机关专项工(gong)作(zuo)责任目标、乡镇经济社会发(fa)展(zhan)主要责任指标考核范围。县信用办(ban)要加(jia)强对各(ge)乡镇、各(ge)部门的(de)督促(cu)检(jian)查,及(ji)时跟踪掌握(wo)各(ge)项工(gong)作(zuo)进(jin)展(zhan)情(qing)(qing)况,督促(cu)检(jian)查任务落实情(qing)(qing)况并及(ji)时报(bao)县政府。
