  伊春市建立完善守信(xin)联(lian)合(he)激励(li)和失信(xin)联(lian)合(he)惩戒制度加快推进社(she)会(hui)诚信(xin)建设(she)实施方案

  为贯(guan)彻落(luo)实《国务院关于(yu)建(jian)立完善(shan)守信联(lian)合激励和失信联(lian)合惩(cheng)戒制度加快(kuai)推进(jin)社会诚信建(jian)设(she)的指导意见》(国发〔2016〕33号)和《黑龙江省人民政府关于建立完善守信联合激励和失信联合惩戒制度加快推进社会诚信建设的实施意见》(黑政规〔2017〕5号)精神,结合我市实际,制定本方案。

  一、总体要求

  (一)指导思想。全面贯(guan)(guan)彻(che)党的十八大和十八届三中(zhong)、四中(zhong)、五(wu)中(zhong)、六中(zhong)全会精(jing)神(shen),深入贯(guan)(guan)彻(che)习近平总书记系列重要(yao)讲话特别是对我省两次重要(yao)讲话精(jing)神(shen),按照(zhao)党中(zhong)央、国务(wu)院(yuan)决策(ce)部署,紧(jin)紧(jin)围绕“四个全面”战略布局,牢固树立创新、协调、绿色、开放、共享发展理念,落实加强和创新社会治理要求,加快推进社会信用体系建设,加强信用信息公开和共享,依法依规运用信用激励和约束手段,构建政府、社会共同参与的跨地区、跨部门、跨领域的守信联合激励和失信联合惩戒机制,促进市场主体依法诚信经营,维护市场正常秩序,营造诚信社会环境。

  (二)工作目标。到2017年底,基本建立政府部门联合奖惩机制,推动企业、自然人、社团组织、机关事业单位信用信息的查询、公开共享和管理应用服务;建立完善信用分类管理、信用信息归集共享、信用信息公示、信用协同监管,使守信激励和失信惩戒机制在重要领域较好发挥作用。到2020年底,全面建成政府与社会共同参与的联合奖惩机制,形成政府部门协同联动、行业组织自律管理、信用服务机构积极参与、社会舆论广泛监督的共同治理格局。

  二、工作任务(wu)

  (一)健全褒扬和激励(li)诚信(xin)行为机制

1.探索(suo)建立行(xing)(xing)政(zheng)审批“绿色(se)通道(dao)”。在(zai)(zai)办(ban)理行(xing)(xing)政(zheng)许(xu)可(ke)过程(cheng)中,对诚信典型(xing)和连续三年无不良(liang)信用记(ji)录的行(xing)(xing)政(zheng)相对人(ren),可(ke)根据实(shi)际情况实(shi)施(shi)“绿色(se)通道(dao)”和“容(rong)缺(que)受(shou)理”等便利服务措(cuo)施(shi)。对符合条件的行(xing)(xing)政(zheng)相对人(ren),除法律法规要求提供的材料外,部分申报材料不齐(qi)备的,如(ru)其书面承诺在(zai)(zai)规定期限内提供,应先行(xing)(xing)受(shou)理,加(jia)快(kuai)办(ban)理进度。(责任单位:中、省、市(shi)直有关单位,各县(xian)〔市(shi)〕、区政(zheng)府(fu))

2.优(you)(you)先提供公共服务(wu)便利。在(zai)实施(shi)财(cai)政性资金项目(mu)安排、招商引资配(pei)套优(you)(you)惠政策等各(ge)类政府优(you)(you)惠政策中,优(you)(you)先考虑诚信(xin)(xin)市(shi)(shi)(shi)(shi)(shi)场主体,加大扶持力(li)度(du)。在(zai)教育(yu)、就业(ye)、创(chuang)业(ye)、医(yi)疗(liao)卫(wei)生、社会保障(zhang)等领域对诚信(xin)(xin)个(ge)人(ren)给予重点支(zhi)持和优(you)(you)先便利。在(zai)有关公共资源交(jiao)易活动中,提倡依(yi)法(fa)依(yi)约对诚信(xin)(xin)市(shi)(shi)(shi)(shi)(shi)场主体采取信(xin)(xin)用加分等措(cuo)施(shi)。(责任单位:市(shi)(shi)(shi)(shi)(shi)发(fa)改委、市(shi)(shi)(shi)(shi)(shi)财(cai)政局(ju)(ju)(ju)〔国资办〕、市(shi)(shi)(shi)(shi)(shi)商务(wu)局(ju)(ju)(ju)、市(shi)(shi)(shi)(shi)(shi)教育(yu)局(ju)(ju)(ju)、市(shi)(shi)(shi)(shi)(shi)人(ren)社局(ju)(ju)(ju)、市(shi)(shi)(shi)(shi)(shi)卫(wei)计委、市(shi)(shi)(shi)(shi)(shi)住建局(ju)(ju)(ju)、市(shi)(shi)(shi)(shi)(shi)国土资源局(ju)(ju)(ju)、市(shi)(shi)(shi)(shi)(shi)交(jiao)通(tong)运输局(ju)(ju)(ju)、市(shi)(shi)(shi)(shi)(shi)水(shui)务(wu)局(ju)(ju)(ju)、市(shi)(shi)(shi)(shi)(shi)水(shui)文局(ju)(ju)(ju)、市(shi)(shi)(shi)(shi)(shi)工商局(ju)(ju)(ju),各(ge)县(xian)〔市(shi)(shi)(shi)(shi)(shi)〕、区政府)

3.优化诚信企业(ye)行政监管安排。各(ge)级市(shi)场监管部门(men)应根据监管对(dui)象的信用记(ji)录(lu)和信用评价分类,注(zhu)重(zhong)运用大(da)数(shu)据手段,完善事中事后(hou)监管措施(shi),为市(shi)场主体提供便利化服务(wu)。对(dui)符(fu)合一定(ding)条件的诚信企业(ye),在日常(chang)检(jian)查、专项(xiang)检(jian)查中优化检(jian)查频(pin)次。(责任单(dan)位(wei):中、省、市(shi)直有(you)关单(dan)位(wei),各(ge)县〔市(shi)〕、区政府)

4.降低市(shi)(shi)(shi)(shi)场(chang)(chang)交易成本。鼓(gu)励(li)(li)有关部(bu)门和(he)单(dan)位开发(fa)“税(shui)易贷(dai)”、“信(xin)(xin)(xin)易贷(dai)”、“信(xin)(xin)(xin)易债”等(deng)守信(xin)(xin)(xin)激励(li)(li)产品。引导(dao)征信(xin)(xin)(xin)机构(gou)(gou)加强对(dui)市(shi)(shi)(shi)(shi)场(chang)(chang)主(zhu)(zhu)体(ti)正面信(xin)(xin)(xin)息(xi)的采集,对(dui)守信(xin)(xin)(xin)者加大(da)激励(li)(li)性(xing)评分(fen)(fen)比(bi)重。引导(dao)金(jin)融机构(gou)(gou)和(he)商业销售机构(gou)(gou)等(deng)市(shi)(shi)(shi)(shi)场(chang)(chang)服务机构(gou)(gou)参(can)考使(shi)用市(shi)(shi)(shi)(shi)场(chang)(chang)主(zhu)(zhu)体(ti)信(xin)(xin)(xin)用信(xin)(xin)(xin)息(xi)、信(xin)(xin)(xin)用积(ji)分(fen)(fen)和(he)信(xin)(xin)(xin)用评价结果,对(dui)诚信(xin)(xin)(xin)市(shi)(shi)(shi)(shi)场(chang)(chang)主(zhu)(zhu)体(ti)给予(yu)优惠(hui)和(he)便利,使(shi)守信(xin)(xin)(xin)者在市(shi)(shi)(shi)(shi)场(chang)(chang)中获得更多(duo)机会和(he)实(shi)惠(hui)。(责任单(dan)位:市(shi)(shi)(shi)(shi)金(jin)融办、市(shi)(shi)(shi)(shi)地税(shui)局(ju)(ju)、市(shi)(shi)(shi)(shi)国税(shui)局(ju)(ju)、人民银行(xing)伊(yi)春市(shi)(shi)(shi)(shi)中心支行(xing)、伊(yi)春银监分(fen)(fen)局(ju)(ju),各县(xian)〔市(shi)(shi)(shi)(shi)〕、区政府(fu))

5.大力推介诚(cheng)(cheng)信(xin)(xin)(xin)(xin)(xin)典型(xing)(xing)。将(jiang)有(you)关部(bu)(bu)门(men)(men)和(he)社会(hui)组织(zhi)实(shi)施信(xin)(xin)(xin)(xin)(xin)用(yong)(yong)分(fen)类(lei)监管确定的(de)信(xin)(xin)(xin)(xin)(xin)用(yong)(yong)状况(kuang)良好(hao)的(de)行(xing)政(zheng)相对人(ren)、诚(cheng)(cheng)信(xin)(xin)(xin)(xin)(xin)道德模(mo)范、优(you)秀青年志愿者(zhe),行(xing)业(ye)协(xie)会(hui)商会(hui)推荐的(de)诚(cheng)(cheng)信(xin)(xin)(xin)(xin)(xin)会(hui)员,新闻(wen)媒体挖掘的(de)诚(cheng)(cheng)信(xin)(xin)(xin)(xin)(xin)主体等树(shu)立(li)为(wei)诚(cheng)(cheng)信(xin)(xin)(xin)(xin)(xin)典型(xing)(xing)。鼓(gu)励有(you)关部(bu)(bu)门(men)(men)和(he)社会(hui)组织(zhi)在(zai)监管和(he)服(fu)务(wu)中建立(li)各类(lei)主体信(xin)(xin)(xin)(xin)(xin)用(yong)(yong)记(ji)录,向社会(hui)推介无(wu)不良信(xin)(xin)(xin)(xin)(xin)用(yong)(yong)记(ji)录者(zhe)和(he)有(you)关诚(cheng)(cheng)信(xin)(xin)(xin)(xin)(xin)典型(xing)(xing),联合(he)其他部(bu)(bu)门(men)(men)和(he)社会(hui)组织(zhi)实(shi)施守信(xin)(xin)(xin)(xin)(xin)激(ji)励。各级政(zheng)府(fu)部(bu)(bu)门(men)(men)应将(jiang)诚(cheng)(cheng)信(xin)(xin)(xin)(xin)(xin)典型(xing)(xing)优(you)良信(xin)(xin)(xin)(xin)(xin)用(yong)(yong)信(xin)(xin)(xin)(xin)(xin)息及时在(zai)政(zheng)府(fu)网(wang)站和(he)“信(xin)(xin)(xin)(xin)(xin)用(yong)(yong)伊春”网(wang)站进行(xing)公示,在(zai)哈洽会(hui)、中俄博览会(hui)、绿(lv)色有(you)机食品博览会(hui)、森(sen)博会(hui)等会(hui)展活动(dong)以及银企对接(jie)等活动(dong)中重点推介诚(cheng)(cheng)信(xin)(xin)(xin)(xin)(xin)企业(ye),让信(xin)(xin)(xin)(xin)(xin)用(yong)(yong)成(cheng)为(wei)市(shi)场配(pei)置(zhi)资源的(de)重要考量因素。(责任(ren)单(dan)位:市(shi)委宣(xuan)传部(bu)(bu)、市(shi)文明办、团市(shi)委、市(shi)工(gong)商局(ju)、市(shi)工(gong)信(xin)(xin)(xin)(xin)(xin)委、市(shi)金(jin)融办、市(shi)民政(zheng)局(ju)、市(shi)商务(wu)局(ju),各县〔市(shi)〕、区政(zheng)府(fu))

  (二)健(jian)全约束和(he)惩戒失信行为(wei)机制(zhi)

6.对(dui)重(zhong)(zhong)(zhong)(zhong)(zhong)点领(ling)(ling)域和(he)(he)(he)(he)严(yan)(yan)(yan)重(zhong)(zhong)(zhong)(zhong)(zhong)失(shi)信(xin)行(xing)为(wei)(wei)实施(shi)联合(he)惩戒。在有关(guan)(guan)(guan)部门和(he)(he)(he)(he)社(she)(she)会组(zu)织(zhi)依(yi)(yi)法(fa)(fa)(fa)(fa)依(yi)(yi)规对(dui)本领(ling)(ling)域失(shi)信(xin)行(xing)为(wei)(wei)作(zuo)(zuo)出处理和(he)(he)(he)(he)评价基础(chu)上,通过信(xin)息共享,推动其他部门和(he)(he)(he)(he)社(she)(she)会组(zu)织(zhi)依(yi)(yi)法(fa)(fa)(fa)(fa)依(yi)(yi)规对(dui)严(yan)(yan)(yan)重(zhong)(zhong)(zhong)(zhong)(zhong)失(shi)信(xin)行(xing)为(wei)(wei)采取联合(he)惩戒措施(shi)。重(zhong)(zhong)(zhong)(zhong)(zhong)点包括:一(yi)是严(yan)(yan)(yan)重(zhong)(zhong)(zhong)(zhong)(zhong)危害(hai)人(ren)(ren)民群众身体健康(kang)和(he)(he)(he)(he)生(sheng)(sheng)命(ming)安(an)(an)(an)全(quan)(quan)的行(xing)为(wei)(wei),包括食品(pin)(pin)药(yao)品(pin)(pin)、医疗卫生(sheng)(sheng)、生(sheng)(sheng)态(tai)环境、工程质量(liang)、安(an)(an)(an)全(quan)(quan)生(sheng)(sheng)产、消防(fang)安(an)(an)(an)全(quan)(quan)、强(qiang)制性产品(pin)(pin)认证(zheng)、特种设(she)备(bei)安(an)(an)(an)全(quan)(quan)、进(jin)出境质量(liang)安(an)(an)(an)全(quan)(quan)和(he)(he)(he)(he)卫生(sheng)(sheng)安(an)(an)(an)全(quan)(quan)等(deng)(deng)领(ling)(ling)域的严(yan)(yan)(yan)重(zhong)(zhong)(zhong)(zhong)(zhong)失(shi)信(xin)行(xing)为(wei)(wei)。二是严(yan)(yan)(yan)重(zhong)(zhong)(zhong)(zhong)(zhong)破(po)坏(huai)(huai)市(shi)(shi)(shi)(shi)(shi)场公平竞争秩序和(he)(he)(he)(he)社(she)(she)会正常秩序的行(xing)为(wei)(wei),包括贿赂(lu)、逃税骗税、恶(e)意逃废债务(wu)(wu)、恶(e)意拖(tuo)欠(qian)货(huo)款或(huo)服(fu)务(wu)(wu)费(fei)、未(wei)与(yu)劳(lao)动者(zhe)(zhe)订立书面劳(lao)动合(he)同、不(bu)(bu)参(can)加(jia)社(she)(she)会保险(xian)(xian)登记、未(wei)足额缴纳社(she)(she)会保险(xian)(xian)费(fei)、恶(e)意欠(qian)薪、非法(fa)(fa)(fa)(fa)集资(zi)(zi)、合(he)同欺(qi)诈、传销(xiao)、无证(zheng)照经(jing)营、制售假(jia)冒(mao)伪劣产品(pin)(pin)和(he)(he)(he)(he)故(gu)意侵(qin)犯(fan)知识产权(quan)(quan)、出借和(he)(he)(he)(he)借用(yong)资(zi)(zi)质投标(biao)、围标(biao)串标(biao)、以(yi)弄虚作(zuo)(zuo)假(jia)或(huo)行(xing)贿方式参(can)与(yu)公共资(zi)(zi)源交(jiao)易、泄漏应当(dang)保密的与(yu)公共资(zi)(zi)源交(jiao)易活动有关(guan)(guan)(guan)的情况和(he)(he)(he)(he)资(zi)(zi)料、虚假(jia)广告、侵(qin)害(hai)消费(fei)者(zhe)(zhe)或(huo)证(zheng)券(quan)期货(huo)投资(zi)(zi)者(zhe)(zhe)合(he)法(fa)(fa)(fa)(fa)权(quan)(quan)益(yi)、严(yan)(yan)(yan)重(zhong)(zhong)(zhong)(zhong)(zhong)破(po)坏(huai)(huai)网络空间(jian)传播秩序、聚众扰乱社(she)(she)会秩序等(deng)(deng)严(yan)(yan)(yan)重(zhong)(zhong)(zhong)(zhong)(zhong)失(shi)信(xin)行(xing)为(wei)(wei)。三是拒(ju)不(bu)(bu)履(lv)(lv)行(xing)法(fa)(fa)(fa)(fa)定义务(wu)(wu),严(yan)(yan)(yan)重(zhong)(zhong)(zhong)(zhong)(zhong)影响司法(fa)(fa)(fa)(fa)机关(guan)(guan)(guan)、行(xing)政(zheng)机关(guan)(guan)(guan)公信(xin)力(li)的行(xing)为(wei)(wei),包括当(dang)事人(ren)(ren)在司法(fa)(fa)(fa)(fa)机关(guan)(guan)(guan)、行(xing)政(zheng)机关(guan)(guan)(guan)作(zuo)(zuo)出判决或(huo)决定后,有履(lv)(lv)行(xing)能力(li)但拒(ju)不(bu)(bu)履(lv)(lv)行(xing)、逃避执行(xing)等(deng)(deng)严(yan)(yan)(yan)重(zhong)(zhong)(zhong)(zhong)(zhong)失(shi)信(xin)行(xing)为(wei)(wei)。四是拒(ju)不(bu)(bu)履(lv)(lv)行(xing)国(guo)(guo)防(fang)义务(wu)(wu),拒(ju)绝(jue)(jue)、逃避兵(bing)役(yi),拒(ju)绝(jue)(jue)、拖(tuo)延民用(yong)资(zi)(zi)源征(zheng)(zheng)用(yong)或(huo)者(zhe)(zhe)阻碍对(dui)被(bei)征(zheng)(zheng)用(yong)的民用(yong)资(zi)(zi)源进(jin)行(xing)改造,危害(hai)国(guo)(guo)防(fang)利益(yi),破(po)坏(huai)(huai)国(guo)(guo)防(fang)设(she)施(shi)等(deng)(deng)行(xing)为(wei)(wei)。(责任单位:市(shi)(shi)(shi)(shi)(shi)工商(shang)局(ju)(ju)(ju)、市(shi)(shi)(shi)(shi)(shi)发(fa)改委(wei)、市(shi)(shi)(shi)(shi)(shi)财政(zheng)局(ju)(ju)(ju)〔国(guo)(guo)资(zi)(zi)办(ban)〕、市(shi)(shi)(shi)(shi)(shi)环保局(ju)(ju)(ju)、市(shi)(shi)(shi)(shi)(shi)住建局(ju)(ju)(ju)、市(shi)(shi)(shi)(shi)(shi)交(jiao)通运输局(ju)(ju)(ju)、市(shi)(shi)(shi)(shi)(shi)公安(an)(an)(an)局(ju)(ju)(ju)、市(shi)(shi)(shi)(shi)(shi)人(ren)(ren)社(she)(she)局(ju)(ju)(ju)、市(shi)(shi)(shi)(shi)(shi)水务(wu)(wu)局(ju)(ju)(ju)、市(shi)(shi)(shi)(shi)(shi)水文局(ju)(ju)(ju)、市(shi)(shi)(shi)(shi)(shi)食品(pin)(pin)药(yao)品(pin)(pin)监(jian)管(guan)局(ju)(ju)(ju)、市(shi)(shi)(shi)(shi)(shi)安(an)(an)(an)监(jian)局(ju)(ju)(ju)、市(shi)(shi)(shi)(shi)(shi)质监(jian)局(ju)(ju)(ju)、市(shi)(shi)(shi)(shi)(shi)地税局(ju)(ju)(ju)、市(shi)(shi)(shi)(shi)(shi)国(guo)(guo)税局(ju)(ju)(ju)、市(shi)(shi)(shi)(shi)(shi)科(ke)技局(ju)(ju)(ju)、市(shi)(shi)(shi)(shi)(shi)人(ren)(ren)防(fang)办(ban)、人(ren)(ren)民银行(xing)伊春市(shi)(shi)(shi)(shi)(shi)中心支行(xing)、伊春出入境检验检疫局(ju)(ju)(ju)、市(shi)(shi)(shi)(shi)(shi)法(fa)(fa)(fa)(fa)院,各县〔市(shi)(shi)(shi)(shi)(shi)〕、区政(zheng)府(fu))

10.加强对失信(xin)(xin)行为(wei)的社(she)(she)会(hui)性约束和惩戒。引导社(she)(she)会(hui)力(li)量广泛参与失信(xin)(xin)联(lian)合惩戒。建立(li)完善(shan)失信(xin)(xin)举报制度,鼓(gu)励公(gong)众举报企业严重失信(xin)(xin)行为(wei),对举报人信(xin)(xin)息严格保(bao)密。鼓(gu)励公(gong)正、独立(li)、有条件的社(she)(she)会(hui)机构开(kai)展失信(xin)(xin)行为(wei)大数据舆情监测(ce),编(bian)制发(fa)(fa)布(bu)地区、行业信(xin)(xin)用(yong)分析(xi)报告(gao)。充分发(fa)(fa)挥各(ge)类社(she)(she)会(hui)组(zu)织(zhi)作(zuo)用(yong),支持有关社(she)(she)会(hui)组(zu)织(zhi)依(yi)法对污染环境、侵(qin)害消费者(zhe)(zhe)或(huo)公(gong)众投资者(zhe)(zhe)合法权益(yi)等(deng)群(qun)体(ti)性侵(qin)权行为(wei)提(ti)起公(gong)益(yi)诉(su)讼。(责任单位:市(shi)工(gong)商局(ju)、市(shi)民(min)政局(ju)、市(shi)环保(bao)局(ju)、市(shi)公(gong)安局(ju),各(ge)县〔市(shi)〕、区政府)

11.完(wan)善个(ge)(ge)人(ren)信(xin)用记录(lu),推(tui)动联(lian)(lian)合(he)(he)惩戒(jie)措(cuo)施落实到(dao)人(ren)。对(dui)企(qi)事业(ye)单位严重失(shi)信(xin)行为,在(zai)(zai)记入企(qi)事业(ye)单位信(xin)用记录(lu)的同时,记入其法(fa)定代表人(ren)、主要(yao)负责(ze)人(ren)和(he)(he)其他负有(you)直接(jie)责(ze)任人(ren)员的个(ge)(ge)人(ren)信(xin)用记录(lu)。在(zai)(zai)对(dui)失(shi)信(xin)企(qi)事业(ye)单位进行联(lian)(lian)合(he)(he)惩戒(jie)的同时,依(yi)照(zhao)法(fa)律法(fa)规(gui)和(he)(he)政策规(gui)定对(dui)相关责(ze)任人(ren)员采取相应的联(lian)(lian)合(he)(he)惩戒(jie)措(cuo)施。通过建立完(wan)整的个(ge)(ge)人(ren)信(xin)用记录(lu)数(shu)据库及联(lian)(lian)合(he)(he)惩戒(jie)机制,使失(shi)信(xin)惩戒(jie)措(cuo)施落实到(dao)人(ren)。(责(ze)任单位:市(shi)编委(wei)办、市(shi)人(ren)社局、市(shi)工商局、市(shi)公安局,各县(xian)〔市(shi)〕、区(qu)政府)

15.建立健全信(xin)(xin)(xin)用修复(fu)机制。联合(he)惩戒措施的(de)发(fa)起部(bu)门和实施部(bu)门应按(an)照(zhao)法律法规(gui)和政策(ce)规(gui)定明确各类失(shi)信(xin)(xin)(xin)行为的(de)联合(he)惩戒期限。在规(gui)定期限内(nei)纠正失(shi)信(xin)(xin)(xin)行为、消(xiao)除(chu)不(bu)良影(ying)响的(de),不(bu)再作为联合(he)惩戒对象。建立有(you)利于(yu)自(zi)(zi)我纠错、主动自(zi)(zi)新的(de)社会(hui)(hui)鼓励与关(guan)爱机制,支持有(you)失(shi)信(xin)(xin)(xin)行为的(de)个人(ren)通(tong)过(guo)社会(hui)(hui)公益服(fu)务等方式修复(fu)个人(ren)信(xin)(xin)(xin)用。(责任单位:中、省、市直有(you)关(guan)单位)

16.建立健全(quan)信(xin)(xin)(xin)用主(zhu)体(ti)权(quan)(quan)(quan)益保护(hu)机制(zhi)。建立健全(quan)信(xin)(xin)(xin)用信(xin)(xin)(xin)息异(yi)(yi)议、投诉制(zhi)度。有(you)(you)关部(bu)门(men)和单(dan)(dan)位(wei)在执(zhi)(zhi)行失信(xin)(xin)(xin)联(lian)合(he)(he)(he)惩戒(jie)措(cuo)施时主(zhu)动发现(xian)、经(jing)市场主(zhu)体(ti)提出异(yi)(yi)议申(shen)请或(huo)投诉发现(xian)信(xin)(xin)(xin)息不(bu)实(shi)的(de),应(ying)及时告知信(xin)(xin)(xin)息提供单(dan)(dan)位(wei)核(he)(he)实(shi),信(xin)(xin)(xin)息提供单(dan)(dan)位(wei)应(ying)尽快核(he)(he)实(shi)并反(fan)馈。联(lian)合(he)(he)(he)惩戒(jie)措(cuo)施在信(xin)(xin)(xin)息核(he)(he)实(shi)期(qi)间暂不(bu)执(zhi)(zhi)行。经(jing)核(he)(he)实(shi)有(you)(you)误(wu)的(de)信(xin)(xin)(xin)息应(ying)及时更(geng)正或(huo)撤销(xiao)。因错误(wu)采取(qu)联(lian)合(he)(he)(he)惩戒(jie)措(cuo)施损害(hai)有(you)(you)关主(zhu)体(ti)合(he)(he)(he)法(fa)权(quan)(quan)(quan)益的(de),有(you)(you)关部(bu)门(men)和单(dan)(dan)位(wei)应(ying)积极(ji)采取(qu)措(cuo)施恢复其信(xin)(xin)(xin)誉、消(xiao)除不(bu)良影响。支持有(you)(you)关主(zhu)体(ti)通过行政复议、行政诉讼等方式维护(hu)自身合(he)(he)(he)法(fa)权(quan)(quan)(quan)益。(责任单(dan)(dan)位(wei):中、省、市直有(you)(you)关单(dan)(dan)位(wei))

  (四)加(jia)强法规制(zhi)度和诚信文(wen)化建设

17.建立完(wan)善(shan)相(xiang)关地方(fang)性(xing)法(fa)规(gui)、政府规(gui)章(zhang)和规(gui)范(fan)标准。加快(kuai)研究推(tui)进(jin)信(xin)(xin)用信(xin)(xin)息归集、共享(xiang)、公(gong)开和使用,以及(ji)失(shi)信(xin)(xin)行为(wei)联(lian)合惩戒等方(fang)面(mian)的立法(fa)工(gong)作,对现行政府规(gui)章(zhang)和规(gui)范(fan)性(xing)文件及(ji)时调整(zheng)修订。按(an)要求统一各部门与黑龙江省(sheng)信(xin)(xin)用信(xin)(xin)息共享(xiang)交换平台间(jian)的数据格式、数据接口,动态(tai)更新(xin)信(xin)(xin)用信(xin)(xin)息征集目录。(责任单位(wei):市工(gong)商局及(ji)中、省(sheng)、市直有关单位(wei),各县(xian)〔市〕、区政府)

  三、保(bao)障(zhang)措(cuo)施

  (一)加(jia)强组(zu)织实施(shi)。各(ge)地、各(ge)有关(guan)(guan)部(bu)门要把实施(shi)守信(xin)(xin)联(lian)(lian)合(he)(he)(he)(he)激(ji)(ji)励和(he)失(shi)信(xin)(xin)联(lian)(lian)合(he)(he)(he)(he)惩戒(jie)(jie)作为推进(jin)社会信(xin)(xin)用(yong)体系(xi)建(jian)设的(de)重要举措(cuo),认真贯(guan)彻(che)落(luo)实本(ben)方案并制定(ding)具体措(cuo)施(shi),切实加(jia)强组(zu)织领导(dao),建(jian)立完善(shan)信(xin)(xin)用(yong)联(lian)(lian)合(he)(he)(he)(he)激(ji)(ji)励惩戒(jie)(jie)工作的(de)各(ge)项(xiang)制度,落(luo)实工作机构、人员编制、项(xiang)目经费等必要保(bao)障(zhang),确保(bao)各(ge)项(xiang)联(lian)(lian)合(he)(he)(he)(he)激(ji)(ji)励和(he)联(lian)(lian)合(he)(he)(he)(he)惩戒(jie)(jie)措(cuo)施(shi)落(luo)实到位(wei)。建(jian)立守信(xin)(xin)联(lian)(lian)合(he)(he)(he)(he)激(ji)(ji)励和(he)失(shi)信(xin)(xin)联(lian)(lian)合(he)(he)(he)(he)惩戒(jie)(jie)的(de)发起(qi)与响应(ying)机制,各(ge)领域守信(xin)(xin)联(lian)(lian)合(he)(he)(he)(he)激(ji)(ji)励和(he)失(shi)信(xin)(xin)联(lian)(lian)合(he)(he)(he)(he)惩戒(jie)(jie)的(de)发起(qi)部(bu)门负责(ze)确定(ding)激(ji)(ji)励和(he)惩戒(jie)(jie)对(dui)象,实施(shi)部(bu)门负责(ze)对(dui)有关(guan)(guan)主体采取(qu)相(xiang)应(ying)的(de)联(lian)(lian)合(he)(he)(he)(he)激(ji)(ji)励和(he)联(lian)(lian)合(he)(he)(he)(he)惩戒(jie)(jie)措(cuo)施(shi)。鼓励有关(guan)(guan)地区和(he)部(bu)门先(xian)行(xing)先(xian)试(shi),通过签署合(he)(he)(he)(he)作备忘录或出(chu)台规(gui)范性文(wen)件等多种方式建(jian)立长效机制,不断丰富信(xin)(xin)用(yong)激(ji)(ji)励内(nei)容,强化信(xin)(xin)用(yong)约束措(cuo)施(shi)。(责(ze)任(ren)单位(wei):中、省、市直有关(guan)(guan)单位(wei),各(ge)县〔市〕、区政府)

  (二)加强(qiang)跟踪问效。充分利(li)用(yong)省信用(yong)信息共享交(jiao)换平台和“信用伊春”网站,建立健全信用联合激励惩戒的跟踪、监测、统计、评估机制并建立相应的督查、考核制度,将考核结果纳入对各地、各部门年度责任目标考核。对信用信息归集、共享和激励惩戒措施落实不力的部门和单位,进行通报和督促整改,切实把各项联合激励和联合惩戒措施落到实处。市工商局要加强统筹协调,及时跟踪掌握工作进展,督促检查任务落实情况并报告市政府。市政府将对本方案的贯彻落实情况适时开展专项督查。(责任单位:市政府办、市工商局,各县〔市〕、区政府)
